Holding trial inside the jail is a blatant violation of the constitution and human rights


Article 27 and 35 (3) of Part III regarding the FUNDAMENTAL RIGHTS of the Constitution of Bangladesh guarantee 'equality before the law' and 'protection in respect of trial and punishment'. Both Articles read, as follows:
27. All citizens are equal before law and are entitled to equal protection of law.
35. (3) Every person accused of a criminal offence shall have the right to a speedy and public trial by an independent and impartial Court or tribunal established by law.

If it is not an open trial, or, if ordinary citizens cannot WITNESS or OBSERVE the trial, in legal terminology it is called an "in Camera Trial". Only in the interest of protecting the privacy or identity of a victim- as happens in the case of a rape or gang-rape victim- in camera trials are held in developed countries when the both parties want such a trial of their choice.

But in the case of Begum Khaleda Zia, the trials that were all based on trumped-up charges have been held in specially constituted court in the ground of Aliya Madrassa where the right to entry of ordinary public was reserved.

Even after she has been granted bail in the case for which she was jailed, the ailing 74-year-old former Prime Minister is being held in an abandoned prison. She is nearly infirm and urgently requires specialised medical treatment for several severe health issues. Yet, the vindictive fascist government is pushing Mrs Zia towards death, by denying her proper medical care.

Begum Zia's health condition has deteriorated to such an extent that the jail authority repeatedly fails to produce her before the Courts for trials. Instead of ensuring the required treatment for detained Khaleda Zia the government of Bangladesh issued a gazette deciding to hold her trial inside the jail. There is no doubt that the ordinary public and even the press would face severe restrictions to witness the trial in the makeshift 'court' in a prison.
Politicians, human rights campaigners, journalists and independent activists from around the world, including Bangladesh's next door neighbour, often intervene in democratic and human rights affairs of Bangladesh. Regrettably, in the case of the 74-year-old former Prime Minister, Khaleda Zia, who is being denied bail having been lately granted in the main case, facing denial of medical treatment. She is the first ever victim to face trial inside jail in Bangladesh's history in an unconstitutional move by Sheikh Hasina's government for political vendetta.  Should the international community maintain strangely nonchalant, silence?


কারাগারের অভ্যন্তরে বিচার পরিচলনা সংবিধান ও মানবাধিকারের লংঘন

বাংলাদেশের সংবিধানের মৌলিক অধিকার সংক্রান্ত তৃতীয় ভাগে অনুচ্ছেদ ২৭ এবং ৩৫(৩) এ দেশের জনগণকে 'আইনের দৃষ্টিতে সমতা' এবং 'বিচার ও দন্ড সম্পর্কে রক্ষণ' সম্পর্কে নিশ্চয়তা দেয়া হয়েছে। এই অনুচ্ছেদ দুইটিতে লেখা আছে:
২৭। সকল নাগরিক আইনের দৃষ্টিতে সমান এবং আইনের সমান আশ্রয় লাভের অধিকারী।
৩৫(৩)। ফৌজদারী অপরাধের দায়ে অভিযুক্ত প্রত্যেক ব্যক্তি আইনের দ্বারা প্রতিষ্ঠিত স্বাধীন ও নিরপেক্ষ আদালত বা ট্রাইব্যুনালে দ্রুত ও প্রকাশ্য বিচারলাভের অধিকারী হইবেন।

প্রকাশ্য বিচার না করা হলে; অর্থাৎ যে কোন সাধারণ নাগরিক যদি সেই বিচার পর্যবেক্ষণ না করতে পারে তাহলে সেটিকে আইনের ভাষায় বলা হয় 'ইন-ক্যামেরা ট্রায়াল'। কেবলমাত্র ভিক্টিমের গোপনীয়তা ও সম্মান রক্ষার্থে যেমন: রেইপ এবং গ্যাং-রেইপের বিচারের ক্ষেত্রে 'ইন-ক্যামেরা ট্রায়াল'কে উভয়পক্ষের সম্মতি সাপেক্ষে অনুমোদন করার নজির বিশ্বের উন্নত দেশগুলোতে দেখা যায়।

কিন্তু বেগম খালেদা জিয়ার বিরুদ্ধে আনীত সাজানো অভিযোগে মাধ্যমে দায়ের করা মামলাগুলো চালানো হয়েছে আলিয়া মাদ্রাসার মাঠে স্থাপিত বিশেষ আদালতে; যেখানে সাধারণ মানুষের প্রবেশাধিকার সংরক্ষিত।

এই ৭৪ বছর বয়ষ্ক বৃদ্ধা নারী ও সাবেক প্রধানমন্ত্রীকে তার মূল মামলায় জামিন পাবার পরও একটি পরিত্যক্ত কারাগারে আটকে রাখা হয়েছে। তিনি অসূস্থ্য ও চলাচল করতে অক্ষম। অবিলম্বে বিভিন্ন শারিরিক অসূস্থ্যজনিত কারণে তার জন্য বিশেষায়িত চিকিৎসার প্রয়োজন। কিন্তু তারপরও বেগম জিয়ার প্রাপ্য চিকিৎসা সেবা না দিয়ে তাঁকে ধীরে ধীরে মৃত্যুর দিকে ঠেলে দেয়া হচ্ছে।

বেগম খালেদা জিয়ার শারীরিক সূস্থ্যতার এতই অবনতি ঘটেছে যে, কারা কর্তৃপক্ষ তাঁকে বিচারাধীন মামলায় আদালতে হাজির করতে অপারগতা প্রকাশ করেছে। এমতাবস্থায় তাঁকে প্রয়োজনীয় চিকিৎসা প্রদানের মাধ্যমে সূস্থ্য করার কোন পদক্ষেপ না নিয়ে বরং কারাগারের অভ্যন্তরেই আদালত বসিয়ে তার বিচার করা জন্য গণপ্রজাতন্ত্রী বাংলাদেশ সরকারের পক্ষ থেকে গেজেট জারি করা হয়েছে। এ কথা বলার অপেক্ষা রাখে না যে, সাধারণ নাগরিকরা তো বটেই; এমনকি গণমাধ্যমের সাংবাদিকরাও কারাগারের অভ্যন্তরে প্রতিস্থাপিত ঐ আদালতের কার্যক্রম পর্যবেক্ষণে প্রবল বাঁধার সমূক্ষীণ হবেন।

বিশ্ব এবং প্রতিবেশি দেশের রাজনীতিবিদ, মানবাধিকারকর্মী ও সাংবাদিকদের প্রায়শঃই বাংলাদেশের বিভিন্ন গণতান্ত্রিক ও মানবাধিকার ইস্যুতে কথা বলতে দেখি। কিন্তু যখন, একজন ৭৪ বছর বয়ষ্ক বৃদ্ধা নারী, যিনি এক সময় দেশের প্রধানমন্ত্রী ছিলেন, তাঁকে তার মূল মামলায় জামিন পাবার পরও চিকিৎসা সুবিধা না দিয়ে পরিত্যাক্ত জেলে আটকে রাখা হয়েছে এবং রাজনৈতিক প্রতিহিংসা বাস্তবায়নের জন্য সংবিধান লংঘন করে বাংলাদেশের ইতিহাসে প্রথবারের মত কারাগারের অভ্যন্তরে আদালত বসিয়ে শেখ হাসিনার সরকার তার উপর আরো নির্যাতন চালাচ্ছে, তখনও কি আন্তর্জাতিক সম্প্রদায় এই বিষয়টিকে উপেক্ষা করে অদ্ভূত নীরবতা পালন করবে?
